Terms of use

These general conditions of sale of ONEDOC SA as seller and you as customer apply to all orders placed in the online store Les Enfants Terribles (www.les--enfants--terribles.ch) and purchases for which ONEDOC SA declares that these general conditions of sale are applicable.

Field of application

The GTC apply to all services provided by ONEDOC SA in the online store (www.les--enfants--terribles.ch) and take effect upon conclusion of a contract. The deliveries, services and offers of ONEDOC AG are carried out exclusively on the basis of these GTC, even if they are not explicitly agreed again. By sending an order to ONEDOC SA, you confirm that you have read these GTC and you expressly agree with them.

Creation of a contract

All information on goods and prices within the framework of the ordering process are non-binding and noncommittal. Orders are binding on the customer. Orders can therefore not be changed or canceled. Customers will receive a non-binding order confirmation from the seller. Before the communication of the shipment, which gives rise to the contract with the seller, ONEDOC SA may cancel its offer without further formality. By placing your order, you confirm that you are clear on the scope and content of your order. Any questions on this subject can be clarified with us beforehand.

Delivery

The delivery of the goods is carried out in principle by post or by courier. The delivery time in Switzerland is generally 1 to 5 working days, unless otherwise stated on the product. These indications are without guarantee.
If the sender does not indicate the correct address or an address where the Post Office cannot find the person, the return costs charged by the Post Office will be borne by the buyer. Once the goods are delivered to the post office, any responsibility of ONEDOC SA is canceled. Therefore, ONEDOC SA does not bear the risks associated with transport.

If, exceptionally, an article of the assortment is not available, we inform you as soon as possible by e-mail. In principle, ONEDOC Ltd. reserves the right to make a partial delivery, insofar as this seems to contribute to the efficient processing of the entire delivery. Of course, in such cases, no additional shipping costs will be charged for the subsequent delivery. In addition, ONEDOC Ltd. reserves the right to demand 100% advance payment for deliveries abroad.

Prices

All prices indicated on www.les--enfants--terribles.ch are inclusive of Swiss statutory VAT (currently 7.7%) and exclusive of shipping costs. The actual shipping costs are indicated in the shopping cart before finalizing the order. ONEDOC SA has the express right to adapt at any time the prices indicated online, without notice and without further explanation. The time of the order on the website is decisive for the calculation of prices.

Shipping costs

Are calculated on the basis of the current prices of the Post Office on: http://www.post.ch/ And in addition all the expenses caused by the packing.

Terms of payment 

You have the following payment options:

Credit card and Twint. We also reserve the right to offer advance payment by bank transfer.

In case of advance payment by bank transfer, the payment period is usually 7 days. In case of non-receipt of the payment within this period, ONEDOC SA reserves the right to cancel the order and to put the goods on sale. The possible expenses of transfer are with the buying party.

Retention of title; set-off; right of retention 

(1) In the case of consumers, we reserve the ownership of the purchased item until full payment of the invoice amount. If you are an entrepreneur in the course of your commercial or self-employed activity, a legal person under public law or a special fund under public law, we reserve the ownership of the item sold until all outstanding claims from the business relationship with the purchaser have been settled. The corresponding warranty claims shall be transferable to third parties.

(2) You shall only have a right of set-off if your counterclaims have been legally established or are undisputed or acknowledged by us. Furthermore, you shall only have a right of retention if and insofar as your counterclaim is based on the same contractual relationship.

(3) If the customer is in default of payment to us, he shall have no claim to a refund.

Warranty 

The warranty for the goods shall be in accordance with the applicable general standards and shall be for a period of 24 months, unless a longer or shorter warranty period is expressly stated on the delivered goods. Defective goods must be reported in writing to the company's address within 10 days of delivery or occurrence of the damage, otherwise the warranty claim will become null and void. The warranty claim begins on the date of delivery. It expires in the event of improper use or natural wear and tear. ONEDOC AG reserves the right to make an individual decision in the case of warranty. 

Return guarantee

Each buyer has the right to return items received to Les Enfants Terribles within 20 days. For returns, the items must be returned in a hygienic condition, otherwise the right to return expires. In the event of a return, shipping costs incurred by Les Enfants Terribles will be charged to the buyer or deducted from the refunded amount. Return shipping costs are the responsibility of the buyer. By accepting the terms and conditions of sale, you also automatically accept our return policy.

Small deviations from the model

It happens that the design of some items changes slightly. Naturally, ONEDOC NV cannot accept any responsibility for such changes made by manufacturers and suppliers.

Maintenance/handling

ONEDOC SA declines any responsibility in case of fault of the customer in the maintenance and / or handling of the articles supplied.

Data protection

ONEDOC SA undertakes to treat your customer data with care and to comply with the provisions of applicable legislation on data protection. In particular, no data is transmitted to third parties. However, no responsibility can be assumed for the security of data transmitted over the Internet.

Marketing

ONEDOC SA reserves the right to reuse the e-mail address and telephone number provided at the time of the order for its own marketing purposes (newsletter & others). It is possible to exclude yourself from this possibility by sending a personal e-mail to hello@les--enfants--terribles.ch.

Product Reviews

Les Enfants Terribles sends automated emails after purchase inviting customers to evaluate the products purchased. Les Enfants Terribles reserves the right to use these and all other reviews (without email invitation) for marketing purposes.

Coupons

Personal coupons that have been created solely for a specific person or group may not be passed on and may only be used by persons authorized by ONEDOC SA. ONEDOC SA reserves the right to cancel any unauthorized order without comment. Only one discount code can be used per order.

Responsibility in general

It is expressly stated that no liability can be invoked by the customer against ONEDOC SA for direct and indirect damages, including consequential damages, insofar as there is no intent or gross negligence on the part of ONEDOC SA for the damage caused. For example, damage caused by accidents, falls, etc., resulting from the handling of Les Enfants Terribles products (bags, etc.) are your own responsibility. 

Modification of the general conditions

ONEDOC SA expressly reserves the right to unilaterally modify these Terms and Conditions at any time without notice.

Applicable law/jurisdiction

In all cases, the relations between you and ONEDOC SA are subject to Swiss law in accordance with the provisions of the Swiss Code of Obligations (CO) and the Swiss Civil Code (CC). The place of jurisdiction is Switzerland. The application of the provisions of the Vienna Convention on the International Sale of Goods ("United Nations Convention on Contracts for the International Sale of Goods") is expressly excluded.

Severability clause

If any provision of this contract is found to be invalid, it shall not be affected. This does not affect the other provisions of this agreement. In this case the invalid provision must be replaced by a new provision which corresponds to the invalid provision. or, if this is not possible, it must be as close as possible to the intended purpose.
